Terms of Service
Effective May 1, 2025
Welcome to The Hook Marketplace and social community. Before using our service we require all of our users to comply with our terms and conditions. This document, rules, policies, and other documents referenced apply to your access and use of The Hook app, website, and related content. To access most features of The Hook, you must register for an account. This contract sets out your rights and responsibilities when accessing the app and website and legally binds you to comply with the guidelines and policies of The Hook.
We reserve the right to amend the Terms at any time by posting a revised version of the Terms and Services effective at the time we post it. Continuing use of the App after changes are made constitutes acceptance of the Terms.
Acceptance of Terms
By accessing or using The Hook Marketplace (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. This Agreement applies to The Hook platform and all related content, tools, features, and service. If you use the service on behalf of a legal entity, the legal entity also agrees to these Terms.
In connection with using and/or accessing the Hook, you will comply with this Agreement and all applicable laws, rules, and regulations.
The Hook will not be liable for any loss or damage arising from your noncompliance with the Agreement.
By using the App, we may send you information electronically. Your electronic agreement is the same as your signature on paper.
Termination of Your Account by You, the User
You may terminate your The Hook Account at any time from your Account Settings. After termination, some of your content, completed transactions and payment information may be retained in our records. You should save all needed information prior to terminating your Account. You are still responsible for all outstanding fees, shipping overages, chargebacks/payment reversals or refunds even after you close your Account. You remain obligated to help resolve any open disputes with other Users from your purchases or sales prior to termination. You are responsible for all fees or payment disputes or reversals received by The Hook, even after you close your Account. Funds owed to The Hook or to others may be removed from your balance or requested via an invoice to be processed as a payment from you or processed by a collections agency.
The Hook issued credits or unused coupons become invalid and expire upon termination of your account.
Description of Service
The Hook Marketplace provides an online consumer to consumer e-commerce marketplace and social media platform to resell fishing and outdoor equipment and to connect with other Users. The App includes social features and facilitates transactions between buyers and sellers. Users can list and sell items and create a social media journal (The Campfire) to share photo, video and written content related to outdoor sport or activity. The Hook does not purchase or sell any items from the Users. Users may be both Buyers and Sellers on the Service. By using the Service, Buyers and Sellers enter into a contract for the sale and purchase of items directly between themselves, and The Hook is not a party to such sale or purchase.
The items in our marketplaces are produced, listed and sold directly by independent third-party sellers. We provide a platform to buy, sell, and discuss products and outdoor activities but we do not inspect, store, verify or guarantee the items listed by users. The Hook cannot and does not make any warranties about items' quality, safety or legality. Any legal claim related to an item you purchase must be brought directly against the Seller of the item. You release The Hook from any claims related to items sold through our Service, including for defective items, misrepresentations by Sellers or items that caused physical injury (like product liability claims).
Buying and Selling
Buyers also must not place orders without the intent to purchase, or place any order that is fraudulent or illegal. The App may not be used to transfer money between a Buyer and Seller that is unrelated to a purchase of goods.
A Seller shall not purchase a product they themselves have listed on a separate Account A Seller may remove a listing from their account at any time.
A Sales Contract is formed with the Seller when the Buyer completes the steps for purchasing a product as prompted on the Service, but before payment is made by the Buyer.
The Hook and its payment processor act as agents for the User in processing payments for purchases. A Buyer's obligation to a Seller for the purchase price shall be deemed satisfied upon receipt by The Hook of the purchase price and Buyer's acceptance of the product.
Once a product has been received by a Buyer, the Buyer shall promptly accept the product and may rate the Seller. Once the Buyer has accepted the product, funds will promptly be processed and released to the Seller through their choice of Payment Instrument. The Seller may use the earnings balance from the sale to: deposit in their bank account by requesting a Direct Deposit; Enroll in Instant Pay and request a direct-to-debit card withdrawal; or choose a Payment Instrument for deposit, or use the earnings balance to purchase goods on The Hook.
The Seller may rate the buyer. If the Buyer does not accept the product as prompted by the Service within three (3) days of delivery, funds will be automatically disbursed to the Seller, payment will be complete and the transaction will be classified as fulfilled and complete. The Hook may need to request additional User Information to help ensure the transfer and purchase is secure, and may retain the earnings until User Information has been verified.
Fees
The fees that we charge Users for the use of our Services are listed on our Fees page. We may change our fees from time to time by posting the changes on the App in advance, but with no advance notice required for temporary promotions or any changes that result in the reduction of fees.
When you purchase an item, taxes may apply to your purchase.
Credits
A User may earn THe Hook issued Credits by participating in various campaigns offered through the Service or as otherwise explicitly provided by The Hook subject to the applicable Credit campaign rules provided by The Hook. A User will not be able to exchange Credits for cash, property, or any other economic benefits other than for the purchase of eligible products through the Service that are specified by The Hook. A User will not be able to transfer Credits to any other User or person. Credits may be refunded in accordance with applicable laws and regulations and displayed by the Service.
Credits expire at 11:59 PM Pacific Standard Time 90 days following the date on which the Credits were earned.

User Eligibility
Users must be at least 13 years old to use the App. Users aged 13-17 must have parental or guardian consent. Use by persons under 13 is strictly prohibited. See our Minor Policy. All Users must reside in the United States of America.
User Accounts
You agree to provide accurate information and keep your account secure. You are responsible for all activity under your account. You must not provide any false information or impersonate another person or company through your Account. The Hook reserves the right to verify the account information you provide. If The Hook determines that your use violates any of our Terms, or is otherwise inappropriate or illegal, or you refuse to provide requested information, or we are unable to verify your information you may be ineligible and we hold the right to terminate your account at the discretion of The Hook.
You may only register for and use one Account per User. Payments and bank accounts can only be registered on Account.
Prohibited Items and Content
A User shall not use their Account for money laundering or any illegal purpose or in violation of any law, regulation or provision of these Terms. We hold all Buyers or Sellers accountable for violations of law, violations of these Terms and all applicable policies. We prohibit User content that is unlawful, abusive, harmful, violent, illegal, infringing on third party rights, false, misleading, fraudulent, pornographic, libelous, invasive, encouraging of money laundering, gambling, or any other unlawful or unwarranted behavior, or otherwise fail to comply with our policies.
You agree not to use the App to sell:
- Firearms, ammunition, explosives or related accessories
- Alcohol, tobacco, illegal substances
- Pornography or explicit images, nudity
- Minor exploitation
Copyrighted third-party content without permission is strictly prohibited. We reserve the right to remove any content or listings that violate these rules.
Product Inspection, Returns and Cancellations
The Hook does not inspect products before resale. Returns are only approved if the product is not as described by the Seller. We provide customer support when transactions are not as described. Buyers may request a return in such cases subject to verification. Returns for reasons such as fit or buyer's remorse are not accepted.Generally, cancellation of a transaction is not permitted once the product has been ordered by a Buyer, however the Seller may choose to cancel the purchase through their account settings for various reasons (eg: lost item, damaged item). The Hook may also cancel a transaction due to potential risk factors.
Return shipping is handled via USPS with labels provided on the App.
Payment, Earnings, and Refunds
We collect payment information to process transactions securely. If you make purchases, you will be asked to provide information about your Payment Instrument(s) which may include credit card, debit card, PayPal, Venmo, Apple Pay, a The Hook balance resulting from your earnings from prior sales, or another payment method permitted by us.The Hook provides secure payment processing services using third party service providers for items listed on its marketplace. Purchases made by the User's Payment Instrument through the App are subject to the terms and conditions between Buyer and the issuer (bank) of the Payment Instrument.
A payment instrument or bank account can only be registered on one The Hook Account at a time. Sellers may have funds from their sales deposited into their designated bank account or withdrawn using Instant Pay.
You may store your Payment Instruments for future use. We may validate that your Payment Instrument is in good standing. You agree that the User Information and Payment Instrument information you provide to us is accurate and that you will keep it updated. By agreeing to these Terms, you authorize The Hook and its payment processor to charge or debit your designated Payment Instrument, when you make transactions or if you incur additional fees or amounts owed to The Hook for the Service. All associated fees will be shown on the purchase receipt.
The Hook does not accept or dispense cash or accept or dispense checks.
Transaction Records, Receipts and Customer Service
Receipts may not be issued to Users for payments made or received on the Service, except as required by applicable law or regulation.
Records of your payment transactions through the Service and The Hook Account balance transactions will be reflected in your transaction history in your The Hook Account. A receipt will also be sent to the email address you provided on your Account. You are responsible for reviewing your payment transaction history to determine if there are any errors or unauthorized transactions, and for immediately alerting The Hook via email at support@the-hook.shop or by calling the 1-800 number listed on your receipts and account statements.
It is your obligation to print or save a copy of your transaction history if desired. Please refer to the Electronic Communications Policy for additional information. In addition to reporting any issues directly to The Hook through various contact us options in the Help Center, residents of certain states may have rights regarding concerns or complaints with our payment services. See the Licenses/Disclosures page for more information.
No Interest
The Hook and its bank do not pay interest to you on earnings or any other funds which are maintained in an Account or otherwise with The Hook. You assign to The Hook the right to earn interest on earnings or other funds maintained with The Hook and its bank.
The Hook is responsible for processing refunds, payment disputes and reversals, and providing customer service in transactions but is not and shall not be involved in other disputes between Users. Payment to The Hook constitutes a payment to the Seller. The Hook processes transactions on behalf of the Seller, and Buyer authorizes Seller to submit charges or credits (in the case of refunds/reversals), as applicable, to the Buyer's Payment Instrument on file. Payments made in connection with the Service shall be made through The Hook using its payments processing providers.
Upon completion of the sale, Seller earnings, minus any applicable charges, will settle in the Sellers account. Fees associated with the sale will be provided on the sales receipt. The Hook will receive a 20% commission on all sales in the app.
Shipping
USPS Priority is used for shipping and label fulfillment. We are not responsible for shipping delays or errors caused by third parties. If the dimensions and weight is greater than what you select for a prepaid label, you are responsible for any charges related to the difference, as well as any fee or penalty that may be imposed by either The Hook or the USPS.
Customer Service
The Hook Marketplace provides customer service support to assist with returns and disputes related to items not as described via chat or email at support@the-hook.shop.
User Conduct
You are solely responsible for any activity and listings on your The Hook Account. Users agree to use the App respectfully and comply with all applicable laws. Harassment, fraud, and abusive behavior will not be tolerated. If you are a Minor (as defined in our Minors Policy) both you and the parent or guardian will be responsible for any activity on the Account.
You own your Content or have the right to use the Content and you license the Content to The Hook with Permission to Use Your Content. By posting Your Content on the App, you grant The Hook a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare works of Your Content to promote The Hook.
User content is public. You understand and agree that (i) the User Content you Post is not confidential; (ii) your User Content may be publicly viewable; and (iii) The Hook will not be liable for any treatment of your User Content as public and non-confidential or for the use of your User Content by third parties. You waive all claims with respect to confidentiality of any User Content.
You are responsible for maintaining the confidentiality of your password and Account. You will immediately notify us of any suspected unauthorized use of your Account or any other suspected breach of Account security.
You are responsible for ensuring your Account accurately reflects your current User Information including your contact information, such as phone number, email and mailing address.
By using the App, you may come across other User content that you find offensive or inappropriate. The Hook is not responsible for the decency, accuracy, or legality of content posted by Users that you accessed through The Hook and you waive any legal action based on other User content. You may report content that you believe violates Policies for our review.
You are solely responsible and liable for your use of The Hook, including buying, selling, transacting, reviewing, and communicating on the App. You are solely responsible for all information, descriptions, pictures, listings, text, music, videos, streaming video, media, comments, messages, sales, purchases, and any other materials and content that you post, send, upload, publish, display, and/or submit. All User Content can be shared with other Users and third parties in The Hook's sole discretion. *The Hook has no control over or liability for how other Users may use your User Content.
You may not:
- Violate any law, rule, or regulation, including any anti-spam, data privacy, or other restriction;
- Interfere with or inhibit other Users from fully using The Hook damage, disable, overburden, or otherwise impair the functioning of the App; promote any illegal activity;
- Stalk, harass, bully, impersonate or solicit information unrelated to the listed item or social interaction;
- Copy, scrape, harvest, crawl or use any technology, software or automated systems to collect any information or data for the Service;
- Pose a privacy or security risk to The Hook and its Users;
- Infringe anyone's intellectual property or postcounterfeit products for sale;
- Infringe the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party;
- Spam any Users with email, junk mail, fraud, schemes;
- Collect or harvest any information or data from The Hook's systems or attempt to decipher any transmission to or from the servers running the Service;
- Use the contact information of any Users, Buyers and Sellers of the Service for any reasons other than: (a) Purchasing through a secure transaction (b) Selling through a secure transaction. Social media interactions must be done through the app comments, and messages;
- Use the Service in any way that is contrary to The Hook's goodwill, or reputation; express or imply that any of your statements, activities, or causes are endorsed by The Hook, without The Hook's prior written consent in each instance;
- Transmit or upload viruses, worms, or otherwise interfere with the Service; violate any local, state, federal and international laws in connection with your use of the App. use The Hook shipping labels to send or transmit items that are illegal or prohibited to ship;
You May Not use The Campfire to post:
- Nudity, pornography or sexually explicit material
- Hate speech, harassment or threats
- Promote violence, illegal activities or self-harm, infringement on the rights of others including copyright or trademark rights
- False or misleading or deceptive statements and information
- Violations of any law or regulation
- Impersonate any person or organization or entity
The Hook may investigate, take legal action, or perform any other action it deems necessary to manage the all content including termination of your Account and/or preservation of such information for investigative purposes at the sole discretion of The Hook.
Intellectual Property
The Hook retains all rights to our intellectual property. All trademarks,service and product names,slogans, logos, trade dress, merchandise, marketing products and media, its look and feel, and content are property of The Hook Marketplace or its licensors. Users may not use any content without permission, create any derivative works of, modify, or reverse engineer any part of The Hook.
Any use of the Service, including the Service Content, other than as specifically authorized herein is strictly prohibited. All goodwill generated from the use of The Hook Trademarks will insure to our exclusive benefit. Any rights not expressly granted herein are reserved by The Hook. Other company, product, and service names and logos used and displayed via the Service are the property of their respective owners. Reference to any products, services, processes, or other information by company, product, or service names and logos does not constitute or imply endorsement, sponsorship, or recommendation by us.
DMCA Copyright Takedown Policy
If you believe that content posted on The Hook Marketplace infringes your copyright, please submit a written notice with sufficient detail to support@the-hook.shop. We will respond and remove infringing content as required by law in accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law. If you knowingly misrepresent that any activity or material on our services is infringing, you may be liable to us for certain costs and damages. If Your Content infringes another person's intellectual property, we will remove it upon receipt of a valid takedown notice and you will be notified.
Limitation of Liability
The Hook Marketplace, its affiliates, officers, and employees shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App, transactions between users, or user-generated content. You agree to use the App at your own risk. We do not inspect nor guarantee the quality, safety, legality or authenticity of the products listed by the users. All purchases are made at the buyer's risk. You release The Hook from any claims related to items sold through our App, including defective items, misrepresentations or items that caused physical injury. To the fullest extent of the law, The Hook Marketplace disclaims any and all warranties and is not liable for for any damages arising from your use of the App, its Service or purchase of products. You must hold The Hook Marketplace harmless from any legal claim or demand (including reasonable attorney's fees) that may arise from your actions, your use (or misuse) of our Service, your breach of the Terms, or your Account's infringement of someone else's rights. This includes (i) your access to, use of, or alleged use of The Hook app (ii) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation; (iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (iv) any dispute or issue between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of that claim.
To the fullest extent, neither The Hook, nor our employees or directors shall be liable to Users for any lost profits or revenues, or for any consequential, incidental, actual, indirect, special or punitive damages arising out of or in connection with the use of The Hook or inability to access the App or any of its features.
The Hook is not liable for any damages or delay, non delivery by the Seller, non-payment or underpayment.
The Hook has no liability for suspending or terminating or restricting your account, including loss of income or ability to generate revenue after termination.
The Hook is not liable for any service interruptions not limited to system failures or other interruptions that may affect purchases, sales, receipts, acceptance, completions, settlement of transactions, bank transfers or the Service.
The Hook shall have no liability for failure or delay resulting from any condition beyond its reasonable control, including but not limited to governmental action, war or acts of terrorism; acts of nature including earthquakes, fire, flood or other acts of God; pandemics, and labor conditions.
Other Disclaimers/Warranties
- The Hook services are provided "as is" and without any kind of warranty (express or implied).
- We do not guarantee that the Service will be secure or available at any particular time or location; The Hook will make reasonable efforts to help ensure that the Service will be free of viruses or other harmful materials and to correct defects once identified.
Dispute Resolution and Arbitration
Any disputes arising out of or relating to these Terms shall be resolved by binding arbitration under the laws of Michigan. This arbitration is the exclusive remedy for any dispute and waives your right to a trial by jury or court litigation, except for seeking injunctive relief. The Hook will not be liable for any loss or damage arising from your noncompliance with the Agreement.
Buyer / Seller Disputes
Returns are only accepted if the product is not as described. No returns or refunds will be accepted for sizing, change of mind, or buyer's remorse.
Sellers and Buyers agree to resolve any disputes directly with each other through the dispute message center in the App. In the event that a dispute escalates to The Hook support, we reserve the right to issue a refund to a Buyer if a transaction is found to be in violation of our terms. Items that are eligible for a refund will generally require that the item is returned to the Seller unless the item is considered hazardous, illegal or in violation of other policies. In this instance Sellers will not be reimbursed for prohibited items.
After a transaction is processed, The Hook is the final arbiter of disputes between Users and The Hook shall not bear any liability related to such disputes. Buyer Accounts may be closed for filing a chargeback without first filing a dispute against the Seller through The Hook Support Center, or for filing false chargebacks.
Third-Party Services Disclaimer
We use third-party providers for payment processing and shipping (e.g., USPS). The Hook Marketplace is not responsible for delays, errors, or losses caused by these providers.
The Service may contain links to third-party websites or services that we don't own or control (eg: Facebook, payment services) that enable you to export information to third party services. You may also need to use a third party's product or service to use some features of our Service (eg: a mobile device, share buttons). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use and privacy policies solely between you and the third party.
The Hook will not be liable for the Third Party Content or any errors, omissions, inaccuracies, infringement, loss, or damage of any kind related to the Third Party Content.
Account Suspension and Termination
We reserve the right to suspend, limit, or terminate any User Account and any related Accounts at our discretion for violation of these Terms, fraudulent activity, or behavior detrimental to the community without notice (unless required by law). The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends. If an Account is suspended, limited, or terminated by The Hook: You don't have a contractual right to use our Service, including buying, selling, or using the social media.You remain responsible for fees, shipping fees, payment disputes/funds reversals, returns or refunds requested and remain obligated to resolve any disputes with other Users that are a result of purchases or sales of goods occurring prior to termination/suspension.
If there is an issue with your Account or listings, your Account balance may be held for up to 90 days. You may be required to provide additional information regarding your Account usage, your identity, your listings or your transactions to release the holds on these funds. Funds for illegal or prohibited activity or items will not be released to you.
Funds may be held for up to 180 days to seek reimbursement from a Seller in any of the following circumstances, when: (a) we provide a refund to a Buyer because a User did not deliver the goods or we otherwise determine that a refund is warranted; (b) we discover erroneous or duplicate transactions; (c) we receive a payment dispute or reversal from a Buyer's Payment Instrument issuer for the amount of a Buyer's purchase from a Seller; or (d) a User violates these Terms or other policies.
We may obtain reimbursement of any amounts owed by a User to The Hook by deducting from future payments owed to the User, reducing any balance from the User's The Hook Account, charging any of the User's Payment Instrument(s) on file, or seeking reimbursement from the Seller by any other lawful means, including by using third-party collections services. You authorize us to use any or all of these methods to seek reimbursement.
The Hook will make ALL refunds or other payments owed to you, as required by applicable law or regulation.
Accounts that are abandoned or balances that are unclaimed are subject to state abandoned property regulations.
Data Retention
We retain user data and transaction history as necessary to comply with legal obligations and for legitimate business purposes. Users may request deletion of personal data where applicable.
Filing Taxes and LLC
If you choose to file taxes or operate your The Hook Account under another tax entity such as a LLC, sole proprietorship or other entity type, all policies, rules and conditions of use as documented in these Terms and related policies will apply to your Account.
You may be required to provide us with current and accurate information about yourself (such as your name, address, date of birth, Social Security number, and/or a copy of your driver's license or other government-issued identification) (“User Information”). If you provide information about a business, such as to comply with a verification request or to complete a W-9 tax reporting form, you may be asked for additional information such as EIN, business address, and/or tax classification filing status in addition to verifying information about yourself and your authority to represent the business or entity(ies).
Apple and App Store Software Applications
To the extent you access The Hook with the Apple App Store, Google Play, or any other similar third party application marketplace, you acknowledge and agree that these Terms are solely between you and The Hook and that between the marketplace provider and The Hook, The Hook is solely responsible for the Service, content, maintenance, support, and addressing any claims relating thereto, including product liability, legal compliance, and intellectual property infringement.Notes
If The Hook determines that there is a need to notify or contact a User, we will do so by sending a text message, email, or letter to the email address or mailing address provided by the User. Alternatively, the notice may be displayed on the App or the website, or by other reasonable means. The Hook is not liable for any damages incurred if communication was not received or was delayed.These Terms do not create any agency, partnership, joint venture, employment or franchisee relationship between you and The Hook.
Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms.
You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms, or any of our rights and obligations under the Terms, at any time without consent.
